WILL  State of Grorgia County of Marion - November 26,1850

Last will and testiment of Richard M.Stewart.To wife,Isabella Stewart,land in
Crawford County adjoining Peter Corbin containing 250 acres more or less,
together with farming tools on aforesaid place,also one road wagon and
harness,all the corn and fodder,wheats and oats that may be made in the year
1851,all the cattle and hogs,two sorrel mules,two other chois mules out of my
lot in Marion County,one bay mare called patsy,all household and kitchen
furniture in Crawford and as much of my household furniture in Marion County
as she may need,one carpet and chairs for the parlor,ten negroes,also 6,000 to
be handed over the first money made or collected after my debts are paid. To
my six children,to wit,William Washington Stewart,Thomas J.Stewart,Mary E.
Stewart,B.F.Stewart,J.L.Stewart,R.A.J.Stewart,all remaining portion of estate,
consisting of two farms,one in Marion and one in Sumter,which farms I desire
to be sold 1 October 1851,to be sold in three payments with first payment due
13 months from day of sale,second due 12 months thereafter and the third still
12 months thereafter.First Tuesday in January 1852,I desire all my negroes of
my place in Marion And Sumter except those willed to my wife to be sold at
such credit as my Executors think proper.Sometimes in the fall of 1851 I
desire that household and kitchen furniture not devised to wife to be sold.
Also the corn,fodder,wheat,oats,and stock to be sold.I desire Mr. Kilcrease to
go on according to contract on the Sumter place improving,build a Gin-house
and screw and make a crop there for the year 1851 receiving the eleventh
portion of the corn and cotton and the same portion of the fattning hogs
according to contract as his pay.Also that Robert Kilcrease proceed according
to contract here on this place in Marion and receive for his wages the
fifteenth of the corn,wheat,oates fodder,and a fourteenth of the cotton.
Thomas C.Horton,shall also go on the farm in Crawford County according to
contract and be paid sixth of all that is made.I desire that each overseer
shall have his cotton crop in the nearest market by the 25th of December 1851
and that my Executors sell it as they think best and to apply the money to
payment of my debts and payment of the 6,000 bequeated to my wife.I desire
that proceeds of the above sales be equally divided among my six children and
loaned out at interest until they become of age or marry,then to receive their
portion.Desire the sales to be published in the current Gazetts of
Albany,Macon,and Columbus three months before the day of sale.If the Crawford
farm doesn't make enough corn,wheat and pork to answer their necessities in
1852 then wife Isaballa Stewart is at liberty to satisfy their wants from my
farm in Marion County.Wife with sister Mary Corbin and Ela Harriet Gray to
remanin at my residence in Marion County free from charge to enjoy all
privileges .
